In a sign that the case filed by Babbitt\u2019s estate and Washington-based Judicial Watch has been\u00a0greenlighted, U.S. District Court Judge Ana C. Reyes gave the government a month to address four of the seven counts in the lawsuit,\u201d the Washington Examiner reported<\/a> on Friday.<\/p>\n \u201cThose four include the \u2018wrongful\u2019 death count as well as negligence and assault and battery claims against\u201d Byrd, the outlet noted further.<\/p>\n The judge also indicated she would consider additional requests from Judicial Watch to move the trial to San Diego, where Babbitt\u2019s husband resides.
