During an interview on Fox News\u00a0Sunday,<\/em> anchor Shannon Bream spoke about Biden\u2019s reform and asked Gorsuch, \u201cHow does the Court feel about potential changes to term limits?\u201d<\/p>\n

In response, the justice said he would not \u201cget into what is now a political issue during a presidential election year,\u201d but added these words: \u201cBe careful.\u201d<\/p>\n

\u201cI have one thought to add. The independent judiciary\u2026what does it mean to you as an American? It means when you are unpopular, you can get a fair hearing under the law and under the Constitution,\u201d Gorsuch said.<\/p>\n

If you\u2019re in the majority, you don\u2019t need judges and juries to hear you and protect your rights, you\u2019re popular. It\u2019s there for the moments when the spotlight\u2019s on you. When the government\u2019s coming after you. And don\u2019t you want a ferociously independent judge and a jury of your peers to make those decisions? Isn\u2019t that your right as an American? And so I just say be careful,\u201d he added, as reported by Newsweek<\/a>.<\/p>\n

Late last month, Biden unveiled a new three-part plan to reform the Supreme Court. His proposal includes imposing term limits on justices, introducing a constitutional amendment to overturn the Court\u2019s ruling on presidential immunity, and establishing an enforceable ethics code for the justices. Currently, Supreme Court justices, like all federal judges, hold lifetime appointments.<\/p>\n

\u201cThe United States is the only major constitutional democracy that gives lifetime seats to its high court Justices,\u201d a fact sheet from the White House reads. \u201cTerm limits would help ensure that the Court\u2019s membership changes with some regularity; make timing for Court nominations more predictable and less arbitrary; and reduce the chance that any single Presidency imposes undue influence for generations to come.\u201d<\/p>\n

Critics of Biden\u2019s plan charge that he and other members of the left-wing Democratic Party only want to change the court\u2019s current 6-3 constitutionalist majority because the justices have issued several rulings in recent years the party opposes. They include upholding the originalist intent of the Second Amendment, returning the issue of abortion to the states where it resided until 1973, and, most recently, overturning the \u201cChevron Doctrine,\u201d in which courts deferred to federal agencies\u2019 own interpretations of their authority.<\/p>\n

Speaking of federal agencies, in another portion of the interview, Gorsuch told Bream<\/a> that the combined authority of the hundreds of federal agencies\u2014whose rules and regulations have the force of law\u2014has essentially turned them into a fourth branch of government, the subject of a recent book by Gorsuch.<\/p>\n

\u201cIt\u2019s not just the laws passed but also the regulatory stuff that has given rise to what critics would call a \u2018fourth branch of government.\u2019 In the book, you say, \u2018Many criminal laws are not the direct product of the elected representatives accountable to us; they\u2019re the handiwork of agency officials\u2026 These days, federal agencies don\u2019t just write and enforce legally binding rules. Often, they act as prosecutor and judge too,’\u201d the host said.<\/p>\n

Gorsuch dropped one big example.<\/p>\n

\u201cThe IRS has a hotline if you have questions \u2014 you don\u2019t want to become a federal felon \u2014 call them. And it turned out, for a period of time, they were giving wrong answers about a third of the time. And then, when asked why there were so many wrong answers, they said, \u2018Well, the IRS tax code had just become so complex; there are just so many new laws.\u2019 There has been an explosion in our laws, and it\u2019s new and it is different it is in our lifetimes,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"
